UK/EU: Applicable law, jurisdiction and judgments in the UK – end of transition and beyond

With the end of the EU/UK transition period approaching, we have updated our briefing note which examines what the UK’s transition out of the EU will mean for the above issues, and the consequent implications for the use of English governing law and jurisdiction clauses.

This update takes into account various developments since it was last published in July 2020 (including, for example, recent UK Brexit Sis and procedural proposals, the UK Private International Law (Implementation of Agreements) Act 2020 and a new UK/Norway bilateral agreement).

We also take a deeper dive into the Hague Choice of Court Convention, in a 2nd edition of our “User's Guide” to the Convention (please click here) and a “Quick Guide” considering its operation more specifically in relation to English jurisdiction clauses and the end of the transition period (please click here).
