Legal privilege for in-house counsels recognised under French law
In October 2023, the principle of privilege of legal opinions drafted by in-house counsels was, for the first time, recognised under French law.
While the enactment of the bill is currently pending the French Constitutional Court’s approval, we explore the conditions and protection afforded by this legal privilege “à la française” and its impact on proceedings before various French administrative bodies (Anti-Corruption Agency, Financial Regulation Authority, Competition Authority and National Commission for Information Technology and Liberties).
