A grab-bag of privilege: The Court of Appeal reviews numerous aspects of LPP
In Al Sadeq v Dechert LLP and others [2024] EWCA Civ 28 the Court of Appeal considered certain important aspects of legal professional privilege (LPP) under English law.
Whilst the case concerns a claim against a law firm, which had conducted an investigation of fraud allegations, it raises LPP points of general application, including the scope of the iniquity exception and the extent to which litigation privilege can exist if the entity claiming litigation privilege was not a party (or an intended party) to the relevant (or reasonably contemplated) litigation.
