Sustainability and Competition Law – A Practical Example of the EU and UK approaches

Sustainability is an increasingly important topic in competition law, with regulators such as the European Commission and UK CMA issuing guidance on how 'green agreements' should be assessed under Article 101(3) TFEU and the national equivalent. Together with Oxera Consulting LLP, we have published an article in the latest edition of the European Competition Law Review which explores the differences between the European and UK approaches, with the UK adopting a potentially broader view of sustainability benefits.
