Brussels-Capital Region ordered to suspend urbanisation of sites larger than 0.5 hectares
On 29 October 2025, the First Instance Court of Brussels ordered the Brussels-Capital Region to suspend urbanisation and prevent impermeability of undeveloped land larger than 0.5 hectares. This measure remains in effect until approval of a revised Regional Land Use Plan, and no later than 31 December 2026.
Key highlights of the decision:
- The Brussels-Capital Region must stop any new urbanisation or sealing of undeveloped land larger than 0.5 hectares immediately.
- This pause stays in effect until a new Regional Land Use Plan is adopted or until 31 December 2026, whichever comes first.
- The court found the Region failed to act urgently on climate obligations and relied on out-of-date planning rules.
- The order was in response to legal action from environmental groups focused on climate risk and land protection.
